Thank you for your trust in Niteo Products, LLC, operating under its family of brands that include  Pyroil, Car Brite,  Cyclo, Motor Medic,  Rain Dance, Tanner's Preserve, No. 7, Rally, AP Formulators and Ozium (“Niteo,” “we,” “us,” or “our”) and for taking the time to read our Privacy Notice. This Privacy Notice tells you how we are committed to protecting the privacy of your personal data that you may provide to us when you visit any of the websites we operate for our company and our brands (our “Services”).

  1. CALIFORNIA NOTICE AT COLLECTION

If you are a California resident, sections below include additional information that we provide pursuant to the California Consumer Privacy Act of 2018 as amended from time to time (“CCPA”), Those sections provide information regarding the categories of personal data to be collected, the purposes for which the categories of personal data are collected or used, whether the personal data is sold or shared and how to opt out, and how long the information is retained.   1. WHAT INFORMATION DO WE COLLECT?

We collect a variety of personal data from and about you through the Services, including:

 

Information You Provide Directly to Us. We collect personal data from you when you provide it to us, including through website forms (including information entered into our search field), as part of the account registration process, processing orders, when you apply for jobs, and when you contact us.

 

Many of the Services do not require any form of registration. However, on some of the Services you may be able to register to receive information or offers. On these pages we will ask you directly for the personal data necessary for us to respond to you, such as name, mailing address, email address, telephone number, usernames, passwords, and

 

If you order products or services from us through the Services, you must provide us with information to process that order and/or enter into a contract with you, including but not limited to name, postal address, email address, telephone number, billing and shipping information, payment information, company name, order history, and other similar information. 

 

You can choose to sign up for communications about us through the Services by providing us with your contact information, such as first and last name, email address, and company name. 

 

If you submit employment inquiries or apply for a job with us through the Services, we may collect identifiers and professional or employment-related information, such as your first and last name, email address, postal address, telephone number, resume, employment and education history, and other information related to your job application and qualifications. To the extent you choose to provide it, we may also collect additional information about legally-protected characteristics, such as your gender, race or ethnicity, military service, and disabilities, to the extent necessary to comply with equal employment opportunity reporting regulations.

 

If you contact us with questions, requests, or complaints, or to exercise your legal rights, we collect any personal data you choose to provide, including personal data necessary for us to answer your questions and address the issue you are contacting us about.

 

Information Collected Automatically. As you navigate through and interact with the Services, we may use automatic data collection technologies, such as those collected by your browsers or devices, to collect certain information about your browsers and devices, including browsing actions and patterns, including the details of your visits to the Services and information about your computer and internet connection, including your IP address, MAC address, operating system, and browser type.

 

We may also use available web-based technologies to collect personal data, such as cookies, or web beacons, including such technologies that are provided by third parties. Cookies are pieces of information stored directly on users’ computers or devices. Cookies allow us to collect information about your use of and interactions or communications with the Services such as browser type, time spent on the online services, pages visited, referring URL, and other traffic and usage data. That information may be collected by or through third parties, such as our service providers. We may also use cookies for purposes such as determining which features interest our users, revising our site features or operations, and as further described below. The Services may also use other tracking systems such as log files and pixel tags, including such systems that are provided by third parties such as our service providers. For example, pixel tags, sometimes called web beacons, are similar in function to a cookie and can tell us certain information like what content has been viewed. The information collected through log files and pixel tags may be collected by or disclosed to a third party.

 

 

We may use data analytics and work with certain third party service providers, such as Google Analytics, to help us understand and improve the use of the Services. These third party service providers may collect information sent by your device as part of a web page request, such as cookies or your IP address. We may also use ad networks to serve advertisements across the Internet. These ad networks use cookies, pixel tags, and other tracking technologies to collect information about your online activity and provide online behavioral advertising.

As described in this section, we may allow third parties to use the Services to collect, receive, and use personal information about your online activities over time and across different websites, applications, and other online products or services. Those third parties may receive the information we collect automatically and use it for measurement services, marketing, advertising, and other purposes on behalf of us, their organization, or their other customers, including delivering targeted or cross-context behavioral advertising.

 

 

Information Obtained from Third Party Sources. We receive personal data from third parties that we have engaged to provide services to us, including website chat providers, as well as from third parties that provide web analytics and usage information to us such as Google Analytics.

In addition, if you choose to interact with us or our partners on social media by posting to our pages, tagging us (or using certain hashtags or other identifiers) in posts, or participating in activities, we may collect certain information from the social media account you use to interact with us, including the name associated with the account, the account handle, recent activity, the content of any posts in which we are tagged, and other information that may be contained on your social media profile to allow us to respond to the posts and understand and engage with our audience. We may also collect data that is not identifiable to you or otherwise associated with you, such as aggregated data, and is not personal data.  This data is not subject to this notice unless it is stored or otherwise associated with your personal data.

 

  1. HOW DO WE USE AND DISCLOSE PERSONAL DATA?

As a general matter, we collect, use, disclose, and store your information to provide you the Services or fulfill your requests. We may use the information we collect from you for the following purposes:

 

  1. Your Consent. We process personal data to the extent you provide your consent, such as when we request to process personal data for a purpose that is not already identified by this Privacy Notice. You have choices when it comes to the technology you use and the data you share. When you are asked to provide personal data or consent to processing, you can decline.  Many of our products require some personal data to operate and provide you with a service. If you choose not to provide data necessary to operate and provide you with a product or feature, you cannot use that product or feature.

 

  1. Performance of a Contract. We process personal data to enter into, or perform under, the agreement between us, such as processing payments, shipping orders, and responding to support or warranty requests. If you do not provide the data, we will not be able to enter into the contract; or if this relates to an existing product you’re using, we may have to suspend or cancel it. We will notify you if this is the case at the time. Where providing the data is optional, and you choose not to share personal data, features like personalization that use the data will not work for you.

However, no method of safeguarding information is completely secure. While we use measures designed to protect personal data, we cannot guarantee that our safeguards will be effective or sufficient. In addition, you should be aware that Internet data transmission is not always secure, and we cannot warrant that information you transmit utilizing the Services is or will be secure.

We retain personal data for as long as necessary to carry out the processing activities described above, including but not limited to providing the Services or content, products, or other services we make available through the Services, compliance with applicable laws, regulations, rules and requests of relevant law enforcement and/or other governmental agencies, and  protecting our and our business partners’ and customers’ rights, property, or safety, and the rights, property, and safety of our users and other third parties.

You have choices about certain information we collect, how we communicate with you, and how we process certain personal data. When you are asked to provide information, you may decline to do so; but if you choose not to provide information that is necessary to provide any aspect of our Services, you may not be able to use those Services.

 

Communications Opt-Out. You may opt out of receiving marketing or other communications from us at any time through a given communications channel (such as email or telephone) by following the opt-out link or other unsubscribe instructions provided in any email message received, by contacting us as provided at the end of this Privacy Notice, or by informing our customer service representatives of your desire to opt out. If you wish to opt out by sending us an email to the address provided below, please include “Opt-Out” in the email’s subject line and include your name and the email address you used to sign up for communications in the body of the email.

 

Note that if you do business with us in the future, you may not, subject to applicable law, opt out of certain automated notifications, such as order or subscription confirmations, based on business transactions (e.g. e-commerce).

 

 

Do Not Track. We use analytics systems and providers and participate in ad networks that process personal data about your online activities over time and across third-party websites or online services, and these systems and providers may provide some of this information to us. We do not currently respond to any web browser’s “do not track” signal or similar mechanisms.

Collection of Personal Data from Children. The Services are not designed for, or directed to, children under the age of 13. When you access these third-party services, you leave our Services, and we are not responsible for, and do not control, the content, security, or privacy practices employed by any third-party websites and services. Sources of Personal Data. We may obtain the categories of Personal Data that we collect as indicated above from the following categories of sources.

 

Use of Personal Data. We may collect, use, or otherwise process the categories of Personal Data that we collect, as described above, for one or more of the business purposes and commercial purposes described in the “How Do We Use and Share Personal Data?” section above.

 

Disclosing Personal Data. We may disclose each of the categories of Personal Data that we collect as indicated above to the categories of third parties described in the “How Do We Use and Share Personal Data?” section above. In the preceding 12 months, we may have disclosed categories of Personal Data listed below to the following categories of third parties for a business purpose:

Categories of Personal Data Sold or Shared for Targeted or Cross-context Behavioral Advertising. 

We do not disclose Personal Data to third parties in exchange for monetary consideration (e.g., a cash payment). However, some applicable laws define “sale” very broadly in a manner that includes disclosing Personal Information in exchange for valuable consideration, and also regulate “sharing” and other use of Personal Information for targeted or cross-context behavioral advertising. We do not have actual knowledge that we sell the Personal Data of consumers under the age of 16 or share the Personal Data of consumers under the age of 16 for targeted or cross-context behavioral advertising.

 

Personal Data Rights and Choices. We have described below some privacy rights we offer to you and others. Where the rights described below are provided by law, there may be limitations or exceptions that apply to your request in accordance with applicable legal requirements. We have described these rights generally, without noting all applicable or potentially applicable limitations or exceptions. When you make a request, we may provide more detailed information regarding any legal requirements applicable to or your request and whether any exception or limitation applies.

 

Right to Confirm Processing and Access to Personal Data. You have the right to request that we confirm that we process your Personal Data, and for access to the Personal Data we have collected about you.

Right to Data Portability. You have the right to obtain a copy of your personal data in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another controller without hindrance.

 

Right to Request Deletion of Personal Data. Subject to certain exceptions, you have the right to request that we delete the Personal Data that we collected about you. Once we receive and confirm your verifiable consumer request, we will delete your Personal Data from our records, unless an exception applies.

 

 

Your Right to Ask Us to Correct Your Personal Data. You can ask us to correct information about you that is inaccurate. We will take into account the nature of the Personal Data and the purposes of our processing when we address your request.

Delaware and Oregon Right to Obtain Information Regarding Third-Party Disclosures. Delaware and Oregon residents may have the right to obtain information regarding the third parties to whom we have disclosed Personal Data.

California Right to Request Information About Our Practices Regarding Personal Data About You That We Collect and Share California. California residents who have an established business relationship with us may request information regarding third parties, if any, to whom we may have disclosed personal information (as defined by Cal. Civ. Code. § 1798.83(e)(7)) for the direct marketing purposes of those third parties during the preceding calendar year. Requests may be made only once per year per person. To submit a request, send an email or letter to addresses provided in the Contact Information and Assistance section at the end of this Privacy Notice.

In addition, if you are a California resident, you have the right to request we disclose certain information to you about our collection, use, and disclosure of your Personal Data during the applicable time period for your request. If we receive and confirm a verifiable consumer request from you pursuant to the Exercising Your Rights section below, we will disclose one or all of the following depending on the scope of the request:

Exercising Access, Data Portability, and Deletion Rights. To exercise the rights described above, you may submit a verifiable consumer request to us by either:

Only you, or an agent that you provide written permission to act on your behalf, may make a verifiable consumer request related to your Personal Data. You may also make a verifiable consumer request on behalf of your minor child.

 

Your request must provide information sufficient to permit us to reasonably verify you are the person about whom we collected California Personal Data, or an authorized agent (except for opt out requests). In order to verify your request, we may ask you to provide information such as your first and last name, email address, postal address, telephone number, or any other information necessary to verify your identity. Your request also must include sufficient detail for us to properly understand, evaluate, and respond to it.

 

We cannot respond to your request or provide you with Personal Data if we cannot verify your identity or authority to make the request and confirm the Personal Data relates to you.

 

If we cannot fulfill, or are permitted to decline, your request then we will alert you or your authorized agent.

 

If your request is manifestly unfounded, repetitive, or excessive, including if you have made several repetitive requests, we may charge a reasonable fee to respond. We also may decline to respond, in which case we will notify you.

 In certain situations, if we do not fulfill your request, you may appeal by contacting us through the methods described above.

 

Non-Discrimination. Subject to certain exceptions, you have a right to not receive discriminatory treatment for exercising your access, data portability, and deletion rights described above.

 

If we process Personal Data to create deidentified information, we will maintain and use such deidentified information in deidentified form and will not attempt to reidentify such deidentified information except to the extent permitted by applicable law. We process Personal Data as described in this Policy.

This Privacy Notice is subject to the Terms of Use that govern your use of the Services. This Privacy Notice applies regardless of the means used to access or provide information through the Services. 

This Privacy Notice does not apply to information from or about you collected by any third-party services, applications, or advertisements associated with, or websites linked from, the Services. The collection or receipt of your information by such third parties is subject to their own privacy policies, statements, and practices, and under no circumstances are we responsible or liable for any third party’s compliance therewith.
